PROVO, UTAH -- A lawsuit filed in small claims court over LDS welfare
benefits was dismissed on Friday when the claimant failed to show up
in court. Sherwin Koyle had claimed that his bishop failed to pay his
mortgage payments.
The filed lawsuit asks for $3,000 that Koyle says he needs to get his
home out of foreclosure. Koyle told the court in his filing that his
bishop had been paying his mortgage payments from LDS Church welfare
funds, but stopped making the payments and failed to notify him that
they had stopped. Payments on the mortgage fell four months behind
before the foreclosure.
Koyle had earlier asked the judge to continue the case until he could
find an attorney to assist him, but on Friday the judge dismissed the
case. Koyle has 10 days to appeal the decision.
